Understand the guidelines for attending and participating in this year's programme.

These terms and conditions (Terms) apply to all persons (the Participant, you and your) who registers to attend Fidelity Life Adviser Edge Professional pathways (Professional pathways) which is run from April to November 2025 in Auckland and Christchurch by Fidelity Life Assurance Company Limited (Fidelity Life, we, us and our). By registering for and/or attending Professional pathways, you are deemed to have accepted these Terms.

1. Registration

1.1 Each Participant will register for Professional pathways via the link contained in the email. Fidelity Life accepts no liability for any registrations not properly completed or received.

1.2 There is no registration fee for participation in the Programme. There are limited places available on Professional pathways and by registering you are committing to attend.

1.3 All travel arrangements to and from the workshop venues and accommodation costs are to be met by you directly for your own account.

2. Expectations and Outcomes

2.1 Professional pathways supports you in meeting your Continuing Professional Development (CPD) training by providing relevant learning to maintain your competence, knowledge, and skills throughout the year. Participants can use their certificate of completion as evidence of their ongoing professional development. Participants will be required to complete all workshop sessions in Professional pathways in order to be awarded with a CPD certificate.

2.2 Fidelity Life will facilitate training sessions for Professional pathways however gives no warranties in respect of any aspect of Professional pathways or any materials related thereto and does not accept any responsibility or liability for reliance by you or any person on any aspect of Professional pathways and/or any materials provided.

2.3 Every effort will be made to adhere to the published timetable and workshop dates. Occasionally, circumstances beyond our control will force changes, amendments or modifications to Professional pathways and its inclusions. Fidelity Life reserves the right to alter a speaker if deemed necessary.

3. Participant’s Obligations

3.1 Each Participant must have a current Fidelity Life Distribution Agreement with us to be eligible to participate in Professional pathways.

3.2 On completion of Professional pathways, we recommend that each Participant makes a publicly available disclosure statement to all its customers in the following terms:
“I have undertaken professional development training through completion of the Fidelity Life Professional Pathways training programme to enhance my knowledge, skills, and client service. This training is designed to maintain competence and meet regulatory standards and does not include any incentives that could influence my advice.”

3.3 You are required to attend all sessions, co-operate with all instructions given and complete all the training modules. If you experience illness or other personal difficulties which may affect your attendance or performance, you should discuss this with us at the earliest opportunity.

3.4 You will not do anything while participating in Professional pathways which brings or would be likely bring us or our brand into disrepute.

4. Cancellation policy

4.1 If you are no longer able to attend Professional pathways, you must notify Fidelity Life in writing by giving no less than thirty (30) business days’ written notice prior to the start date of Professional pathways (such notice can be given via electronic mail to adviseredge@fidelitylife.co.nz). Fidelity Life will acknowledge receipt of your notice via return electronic mail.

4.2 Fidelity Life reserves the right to on-charge any costs and expenses that it has or will incur in relation to your registration for Professional pathways where you fail to attend Professional pathways in whole or in part.

4.3 Fidelity Life reserves the right in its sole discretion, to cancel or postpone Professional pathways at any time for any reason. Where Fidelity Life decides to do so, it will give as much notice as reasonably possible.

4.4 Fidelity Life may also cancel or postpone Professional pathways in the case of a force majeure event which includes any circumstances beyond its reasonable control including (but not limited to) an Act of God, war, pandemic, epidemic, revolution or any unlawful act against public order or authority, an industrial dispute including strike or other labour disturbances, a governmental restraint, or where a state of emergency has been declared.

4.5 Fidelity Life will not be liable for any costs you incurred in relation to Professional pathways, in the case that Professional pathways is cancelled after your registration.

5. Marketing and Promotion

5.1 We have the right to use your name and images obtained in relation to your participation in Professional pathways for promotional purposes and these materials will remain our property.

5.2 You agree that, after your participation in Professional pathways has concluded, we may contact you to explore opportunities for you to share your experience. You will have the option to participate in events hosted by us to celebrate and promote Professional pathways. This may include, without limitation, speaking engagements, writing articles, and taking part in interviews and media stories, by mutual agreement.

6. Liability and Indemnity

6.1 You expressly agree that Fidelity Life and its related entities and each of their respective legal representatives, directors, agents, employees, contractors and officers shall not be liable for any loss, injury or damage of any kind whatsoever suffered directly or indirectly by any person, possession or property in connection with Professional pathways or any other activities of Fidelity Life, for any reason whatsoever, no matter how that loss, injury or damage was caused.

6.2 You agree to indemnify Fidelity Life for any actual, incurred and direct losses, damages, costs and expenses incurred arising out of non-compliance with any reasonable rules, guidance or instructions provided by any Fidelity Life or venue representative in the course of Professional pathways.

6.3 In the case of the Auckland venue, unless otherwise agreed by Fidelity Life, access to the premises of Fidelity Life at Level 4, 136 Fanshawe Street, Auckland 1010 (Fidelity Premises) will be via reception / sign in portal. You may be given passes and/or security cards which must be worn at all times in accordance with Fidelity Life’s policies. Any passes or security cards must be handed in to Fidelity Life’s reception when leaving the Fidelity Premises. The loss of any pass or security card must be reported immediately to Fidelity Life’s reception. Fidelity Life has the right to remove from the Fidelity Premises any Participant who, in Fidelity Life’s opinion, may endanger the safety or welfare of any person, compromise the security of the Fidelity Premises or Fidelity Life’s systems, or fail to comply with Fidelity Life’s internal procedures, policies or controls.

7. Confidentiality and Privacy

7.1 During your participation in Professional pathways, we and/or you may become aware of confidential information about each other, and other parties related to Professional pathways. Confidential information includes these Terms, and any information in any form provided by one of us to the other. It includes any personal information and information relating to the business assets, affairs, operations, financial position, policies, products, services, customers, employees, contractors, third party providers and intellectual property.

7.2 Confidential information does not include information which is now or later becomes in the public domain or that was known to each of us unrelated to your participation in Professional pathways.

7.3 Any confidential information remains the property of the party to whom it belongs and relates and should be kept confidential by the other party and used only for the purposes set out under these Terms and be disclosed only where required for the purposes of performance under these Terms or with the other party’s written consent.

7.4 In the case that either of us becomes aware that any confidential information has been or may have been accessed, used, stored, reproduced or disclosed in a manner that does not comply with this clause we must notify each other immediately and provide all reasonable assistance to each other, including co-operating in any action which must be taken to protect the confidentiality, privacy and security of the confidential information.

7.5 All personal information will be collected, used, stored and disclosed in accordance with the Privacy Act 2020, and in accordance with our Privacy Policy which can be accessed here. The primary purpose for collection of the information is for administration of Professional pathways.

8. Miscellaneous

8.1 Fidelity Life reserves the right to change, suspend or cancel these Terms at any time by notice in writing to you.

8.2 Where disputes or issues arise, we will work collaboratively together to try to find a solution. We will do this by first meeting with each other to discuss the issues. If we cannot resolve the issues ourselves then we agree to engage a mediator to help us. If we can’t agree on one, we will have one appointed by the President of the New Zealand Law Society.

8.3 Clauses 6, 7 and 8.2 will survive termination of these Terms, together with such provisions of these Terms that are by their nature intended to survive termination.

8.4 All intellectual property rights in and to Professional pathways content and all materials distributed at or in connection with Professional pathways are owned by Fidelity Life. You may not use or reproduce (or allow anyone to use or reproduce) any such intellectual property (including any written content or materials) for any reason without the prior written approval of Fidelity Life.

8.5 All workshop events are held within New Zealand.

8.6 These Terms are governed by the laws of New Zealand, and you submit to the exclusive jurisdiction of the courts of New Zealand.
